Further to the 2020 “Guide for application requirements for 3D marks,” the TM5 Partners published the Guidelines for Searching Non-Traditional Marks.
These Guidelines serve as useful reference material for office examiners, applicants and rights owners on how to conduct trademark searches in the databases of the TM5 Offices for non-traditional marks, which may be challenging in some situations where the representations of marks can be complex.
Detailed instructions are provided for searching a wide variety of marks, including three-dimensional marks, sound marks, hologram marks, position marks, motion marks, scent marks, taste marks, multimedia marks, touch marks, store layout marks, and marks for single colors and color combinations.
